4. For What Purposes Do We Process Your Data?
When you use our services, visit www.delipet.com (“Website”), or otherwise interact with us, we may collect and process various categories of your personal data.

In general, we may collect and process such data for the following purposes:

4.1 Communication
We may process personal data in order to communicate with you and third parties by e-mail, telephone, post, or other means (e.g. responding to inquiries, providing legal advice and representation, or initiating and managing contractual relationships).

This also includes providing customers, business partners, and other interested parties with information about legal developments, company news, and similar matters. Such communications may take the form of newsletters or other regular communications by electronic means, post, or telephone.

You may object to such communications at any time or withdraw any consent previously granted.

For these purposes, we process, in particular, the content of communications, your contact details, communication metadata, and, where applicable, image and audio recordings of telephone or video calls.

If a call or meeting is recorded, you will be informed separately and may request that no recording take place or terminate the communication.

Where necessary, we may collect additional information to verify your identity (for example, a copy of an identification document).

4.2 Initiation and Conclusion of Contracts
For the purpose of entering into contracts, we may process your name, contact details, contractual information, contract date, creditworthiness information, and any other information that you provide to us or that we obtain from public sources or third parties.

4.3 Administration and Performance of Contracts
We may process personal data in order to fulfil our contractual obligations towards customers and other business partners (such as suppliers, service providers, and project partners), including providing and enforcing contractual services.

For this purpose, we process data obtained during the initiation, conclusion, and performance of contracts, as well as data generated in connection with the provision of our services.

4.4 Operation of Our Website
To ensure the secure and stable operation of our website, we collect technical information such as IP addresses, operating system information, device settings, region, date and time of access, and type of use.

We also use cookies and similar technologies. Further information can be found in Section 8.

4.5 Improvement of Our Electronic Services
To continuously improve our website and other digital services, we collect information about your behaviour and preferences, for example by analysing how you navigate our website and interact with our social media profiles.

4.6 Registration
Certain services and features (such as free Wi-Fi access or newsletters) require registration, either directly with us or through external login providers.

For this purpose, we process the information provided during registration. We may also collect personal data during your use of these services and will provide additional information where required.

4.7 Security Purposes and Access Controls
We process personal data to ensure and continuously improve the security of our IT systems and other infrastructure, including our buildings.

This includes monitoring and controlling electronic access to IT systems, conducting analyses and tests of IT infrastructure, performing system and error checks, and creating backup copies.

4.8 Compliance with Laws, Official Instructions and Internal Regulations
We may process personal data to comply with applicable laws, self-regulatory requirements, certifications, industry standards, official recommendations, and internal policies.

4.9 Risk Management and Corporate Governance
We may process personal data as part of risk management activities (e.g. preventing fraudulent or unlawful activities) and corporate governance.

This includes business organisation activities such as resource planning and corporate development activities such as acquisitions, sales, or restructuring of business units.

4.10 Job Applications
If you apply for a position with us, we process the relevant personal data for the purpose of evaluating your application, conducting the recruitment process, and, if successful, preparing and concluding an employment agreement.

In addition to your contact details and communications with us, this may include information contained in your application documents and information obtained from professional social networks, the internet, media sources, or references, where you have consented to such reference checks.

The processing of personal data in connection with employment relationships is governed by a separate privacy policy.

4.11 Other Purposes
Additional purposes include training and educational activities, administrative functions such as accounting, quality assurance, and documentation.

For training, evidence, and quality assurance purposes, we may monitor or record telephone calls and video conferences. In such cases, you will be informed in advance and may object to the recording or terminate the communication. If you only wish to avoid recording your image, you may switch off your camera.

We may also process personal data for the organisation, implementation, and follow-up of events, including participant lists, presentations, discussion content, photographs, audio recordings, and video recordings made during such events.

The protection and pursuit of other legitimate business interests may also require the processing of personal data.

5. Where Does the Data Come From?
5.1 From You
Most of the data we process is provided directly by you (or your device), for example in connection with our services, the use of our website and applications, or through communication with us.

You are generally not obliged to provide your personal data, except in specific cases (e.g. where required by law). However, if you wish to enter into a contract with us or make use of our services, you must provide certain information. The use of our website also requires the processing of certain data.

5.2 From Third Parties
We may also obtain data from publicly accessible sources. This includes, in particular, data that we process in connection with the initiation, conclusion, and performance of contracts.

6. To Whom Do We Disclose Your Data?
In connection with the purposes described in Section 4, we may disclose your personal data to the categories of recipients listed below. Where required, we obtain your consent or seek a release from our professional confidentiality obligations from the competent supervisory authority.

6.1 Service Providers
We work with service providers in Switzerland and abroad who process data:

(i) on our behalf (e.g. IT providers),
(ii) jointly with us as joint controllers, or
(iii) independently as their own controllers using data received from us or collected on our behalf.

Such service providers may include IT providers, banks, insurance companies, debt collection agencies, credit agencies, address verification services, and consulting firms.

As a rule, we conclude agreements with these third parties regarding the use and protection of personal data.

6.2 Customers and Other Contractual Partners
This primarily includes our customers and other contractual partners where the disclosure of your data results from the contractual relationship (for example, because you work for a contractual partner or because that partner provides services to you).

These recipients generally process the data under their own responsibility.

6.3 Other Persons
This refers to situations where the involvement of third parties arises from the purposes described in Section 4.

Examples include recipients of deliveries or payments specified by you, third parties acting as your representatives (such as your lawyer or bank), and persons involved in administrative, governmental, or court proceedings.

If we cooperate with media organizations and provide them with materials (e.g. photographs), you may also be affected.

As part of our business development activities, we may buy or sell businesses, business units, assets, or companies, or enter into partnerships. This may result in the disclosure of personal data (including data relating to you as a customer, supplier, or representative) to the parties involved in such transactions.

Data may also be exchanged in the course of communications with competitors, industry organizations, associations, and other professional bodies.

All of these categories of recipients may engage third parties themselves, which means that your data may also become accessible to them.

While we can restrict the processing activities of certain third parties (e.g. IT service providers), we cannot control the activities of others (e.g. authorities, banks, or courts).

We also allow certain third parties to collect personal data from you on our website and at our events under their own responsibility (e.g. media photographers or providers of tools integrated into our website).

Where we are not substantially involved in such data collection activities, those third parties are solely responsible for them. For questions or to exercise your data protection rights, please contact those third parties directly.

Information about your rights can be found in Section 8. Information about activities on our website can be found in Section 9.

7. Is Your Personal Data Also Transferred Abroad?
We process and store personal data primarily in Switzerland and within the European Economic Area (EEA). Depending on the circumstances, however, data may also be processed in any country worldwide, for example through subcontractors of our service providers or in proceedings before foreign courts or authorities.

As part of our activities for customers, your personal data may also be transferred to countries around the world.

Where a recipient is located in a country that does not provide an adequate level of data protection, we contractually require that recipient to comply with an appropriate level of data protection. For this purpose, we use the revised Standard Contractual Clauses issued by the European Commission, including the amendments required under Swiss law, unless the recipient is already subject to a legally recognized framework ensuring adequate data protection.

We may also transfer personal data to countries without an adequate level of protection without entering into a specific agreement if an applicable legal exception exists.

Such exceptions may apply, in particular, in connection with legal proceedings abroad, overriding public interests, the performance of a contract in your interest, your consent, situations where obtaining your consent is not reasonably possible and the transfer is necessary to protect your life, physical integrity, or that of another person, or where the data has been made publicly available by you and you have not objected to its processing.

In certain cases, we may also rely on exceptions for data obtained from legally established public registers (e.g. commercial registers) to which we have lawful access.

8. What Rights Do You Have?
As a user of our website, you have various rights regarding your personal data. These rights are set out in the Swiss Federal Act on Data Protection (FADP) and, where applicable, in the European Union's General Data Protection Regulation (GDPR), if we process data relating to EU citizens.

An overview of these rights is provided below:

8.1 Right of Access
You have the right to obtain information at any time about the personal data we process concerning you. This includes information about the purpose of the processing, the categories of personal data processed, the recipients or categories of recipients to whom the data has been disclosed, and the planned retention period.

8.2 Right to Rectification
You have the right to request the correction of inaccurate personal data or the completion of incomplete personal data stored by us.

8.3 Right to Erasure
You may request the deletion of your personal data, provided that the processing is not necessary for exercising the right to freedom of expression and information, complying with a legal obligation, reasons of public interest, or the establishment, exercise, or defence of legal claims.

8.4 Right to Restriction of Processing
Under certain circumstances, you may request the restriction of the processing of your personal data. Restriction means that, apart from storage, the data may only be processed with your consent or for the establishment, exercise, or defence of legal claims.

8.5 Right to Data Portability
You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format or to request that it be transferred to another data controller.

8.6 Right to Object
If the processing of your personal data is based on legitimate interests, you have the right to object to such processing at any time on grounds relating to your particular situation.

8.7 Right to Withdraw Consent
Where processing is based on your consent, you have the right to withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

8.8 Right to Lodge a Complaint with a Supervisory Authority
You have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data.

If you wish to exercise any of your rights, please contact us using the contact details provided in Section 3.

To prevent misuse, we may need to verify your identity (for example, by requesting a copy of an identification document where necessary).

Please note that these rights may be subject to conditions, exceptions, or limitations (for example, to protect third parties or trade secrets). We reserve the right to redact copies or provide information only in part where required for data protection or confidentiality reasons.

9. How Are Cookies, Similar Technologies and Social Media Plug-ins Used on Our Website and Other Digital Services?
When you use our website (including newsletters and other digital services), certain data is generated and stored in log files, particularly technical data.

In addition, we may use cookies and similar technologies (such as pixel tags or fingerprints) to recognize website visitors, analyse their behaviour, and identify preferences.

A cookie is a small file that is transmitted between the server and your device and enables the recognition of a specific device or browser.

You can configure your browser to automatically reject, accept, or delete cookies. You may also disable or delete cookies individually. Information on how to manage cookies can be found in your browser’s help menu.

The technical data we collect and the cookies we use generally do not contain personal data. However, personal data stored by us or by third-party service providers acting on our behalf (for example, where you have a user account with us or those providers) may be linked to technical data or information stored in and obtained from cookies and may therefore be associated with your identity.

We also use social media plug-ins. These are small software components that create a connection between your visit to our website and a third-party provider.

The social media plug-in informs the third-party provider that you have visited our website and may transmit cookies previously placed by that provider on your web browser.

Further information on how these third parties use personal data collected through their social media plug-ins can be found in their respective privacy policies.

In addition, we use our own tools and third-party services (which may themselves use cookies) on our website, particularly to improve the functionality or content of our website (e.g. integrating videos or maps), generate statistics, and display advertising.

We may currently use services provided by various service providers and advertising partners. Their contact details and further information regarding individual data processing activities can be found in their respective privacy policies.

Please visit our "Placed Cookies" section for further information.

Some of the third-party providers we use may be located outside Switzerland. Information regarding the transfer of personal data abroad can be found in Section 7.

From a data protection perspective, some of these providers act merely as data processors on our behalf, while others act as independent data controllers. Further details can be found in their respective privacy policies.

10. How Do We Process Personal Data on Our Social Media Pages?
We may operate pages and other online presences on social networks and third-party platforms and process personal data about you in this context.

We receive data from you (for example, when you communicate with us or comment on our content) and from the platforms themselves (for example, statistical information).

The platform providers may analyse your use of their services and process this data together with other information they already hold about you. They also process this data for their own purposes, such as marketing, market research, and platform administration, and act as independent data controllers for these purposes.

11. Additional Information
We do not generally assume that the European Union General Data Protection Regulation (“GDPR”) applies to our activities. However, should the GDPR exceptionally apply to specific data processing activities, the provisions of this Section 11 shall apply exclusively for the purposes of the GDPR and the data processing activities governed by it.

We process your personal data primarily on the basis that:

it is necessary, as described in Section 4, for the initiation, conclusion, administration, and enforcement of contracts (Article 6(1)(b) GDPR);
it is necessary to protect our legitimate interests or those of third parties as described in Section 4, particularly for communicating with you or third parties, operating our website, improving our electronic services, registering users for certain services and offers, ensuring security, complying with Swiss law and internal regulations, carrying out risk management and corporate governance activities, and for other purposes such as training and education, administration, documentation, evidence preservation, quality assurance, event organisation, implementation and follow-up, and safeguarding other legitimate interests (see Section 3) (Article 6(1)(f) GDPR);
it is required or permitted by law based on our mandate or legal status under the laws of the EEA or an EEA member state (Article 6(1)(c) GDPR), or it is necessary to protect your vital interests or those of another natural person (Article 6(1)(d) GDPR).
We generally process your data for as long as required by our processing purposes (see Section 3), statutory retention periods, and our legitimate interests, particularly for documentation and evidentiary purposes, or where storage is technically necessary (e.g. in backup systems or document management systems).

Unless legal, contractual, or technical reasons prevent us from doing so, we will generally delete or anonymise your data after the applicable retention or processing period has expired, in accordance with our standard procedures and retention policies.

If you do not provide certain personal data, this may result in our inability to provide the related services or enter into a contract with you. We generally indicate where the provision of personal data is mandatory.

The right to object to the processing of your data as described in Section 8 applies in particular to data processing carried out for direct marketing purposes.

If you are dissatisfied with how we handle your rights or with our data protection practices, please contact us using the contact details provided in Section 2.

If you are located within the EEA, you also have the right to lodge a complaint with the data protection supervisory authority in your country. A list of EEA supervisory authorities can be found at:

https://edpb.europa.eu/about-edpb/board/members_en

12. Data Security
We take the protection of your personal data very seriously and treat your personal information confidentially and in accordance with applicable data protection laws and this Privacy Policy.

To ensure the security of your data during transmission and to prevent unauthorised access by third parties, we use state-of-the-art security standards and technologies.

12.1 Measures to Secure Data Processing
Encryption

For security reasons and to protect the transmission of confidential content, such as inquiries sent to us through our website, we use SSL/TLS encryption.

You can recognise an encrypted connection when the browser address changes from “http://” to “https://” and a padlock symbol appears in your browser’s address bar.

Security Protocols

We use various security measures and protocols to control access to our systems and ensure that only authorised persons have access to your data.

These measures include regular security reviews and updates of our systems.

Data Backups

Regular data backups help ensure the rapid recovery of data in the event of a technical issue.

12.2 Communication via the Contact Form
To ensure a high level of security for messages submitted through our contact form, we use the SMTP server provided by Amazon Web Services Simple Email Service (AWS SES).

AWS SES is a reliable and secure email service designed to provide high availability, reliability, and compliance with internationally recognised security standards.

This helps ensure that your messages are transmitted securely and protected from unauthorised access.

12.3 Use of Cloudflare
To improve the security and performance of our website, we use Cloudflare, a content delivery network (CDN) and security service provider.

Cloudflare acts as a proxy between visitors to our website and our hosting provider, meaning that website traffic is routed through Cloudflare’s network.

This helps protect our website against DDoS attacks, improves loading speeds, and ensures secure data transmission through SSL encryption.

Cloudflare may collect certain information about website visitors in order to provide these services.

12.4 Use of a Web Application Firewall (WAF)
To ensure a high level of security on our website, we use Cloudflare’s Web Application Firewall (WAF).

This advanced security measure is designed to protect our website against various threats, including Cross-Site Scripting (XSS), SQL injection, and other types of cyberattacks.

The WAF analyses and filters incoming traffic to our website to ensure that only legitimate traffic is allowed through. This helps increase the security of data transmitted through our website and protects our visitors from potential security risks.

We are committed to regularly reviewing and improving our security measures to ensure the ongoing protection of your data.

13. Changes to This Privacy Policy
We reserve the right to amend or update this Privacy Policy at any time in order to adapt it to changes in legal requirements, our services, or our data processing activities.

Any changes will be published on our website. The current version of this Privacy Policy can be accessed at any time on our website.

13.1 Important Changes
In the event of significant changes affecting the way we process your personal data or the purposes for which it is processed, we will inform you appropriately, for example through a prominent notice on our website or by direct communication (e.g. by e-mail), provided that we have the necessary contact information.

13.2 Review of This Privacy Policy
We recommend that you review this Privacy Policy regularly to stay informed about how we protect and process your data.

Your continued use of our services after any changes to this Privacy Policy have been made shall constitute your acceptance of those changes, to the extent permitted by applicable law.

13.3 Date of Last Update
The date of the most recent update of this Privacy Policy can be found both at the beginning and at the end of this document.
